By using this web site campusmagnolie.it by Giorgia Casoni, you consent to our use of cookies in accordance with this Cookie Policy. If you do not agree to our use of cookies, you must set up your browser appropriately or not use the site. If you decide to disable the cookies we use, this may affect the user experience while on this site.

What are cookies?

Cookies are small strings of text that the website visited by users send to their terminal (usually to the browser), where they are stored to be retransmitted to the same sites upon the next visit of the same user. While browsing a website, users can also receive cookies on their terminal that are sent from different websites or web servers (“third parties”) on which are located some elements (such as images, Maps, sounds, specific links to pages of other domains) present on the website they are visiting.

Cookies, commonly found in user browsers in large numbers and sometimes with an extensive persistence in time, are used for different purposes: running computer authentication, session monitoring, storing information on specific configurations for users access Servers and so on.

In order to achieve proper regulation of such devices, it is necessary to distinguish them where there are no technical characteristics that differentiate them from each other on the basis of the purposes pursued by those who use them. However, also the  legislator acted in this direction, implementing the provisions of Directive 2009/136 / EC, stating the obligation to acquire informed consent of users for the installation of cookies used for other than merely technical purposes (see Article 1, paragraph 5, letter a) of the d. lgs. May 28, 2012, no. 69, which amended art. 122 of the Code).

In this respect, and for the purpose of this provision, two macro-categories have been identified: technical cookies and “profiling” cookies.

a. Technical Cookies.

Technical cookies are only used to “transmit a communication on an electronic network or to the extent strictly necessary for the information society provider of a service explicitly required by the subscriber or user to provide such service “(see Article 122 (1) of the Code).

They are not used for further purposes and are normally installed directly by the holder or web site manager. They can be subdivided into navigation or session cookies that ensure the normal browsing and use of the website (allowing, for example, a purchase or authentication to access restricted areas); Cookie analytics, similar to technical cookies when used directly by the site manager to gather information about the number of users and how they visit the site; Feature cookies that allow the user to navigate according to a set of selected criteria (for example language, products selected for purchase) in order to improve the service provided.

For the installation of such cookies no prior consent of users is required, while there is the obligation to provide information, pursuant to art. 13 of the Code, which site managers may provide with the methods they find most appropriate.

b. Profiling cookies.

Profiling cookies are designed to create user profiles and are used to send advertisement in line with the preferences displayed by the same user while browsing the network. Due to the particular invasiveness that such devices may have in the private sphere of users, European and Italian legislation provides that users should be properly informed of their use in order to express their true consent.

They refer to art. 122 of the Code where it is stated that “the storage of information in the server of a contractor or user, or the access to previously archived information is only permitted provided that the contractor or the user has given their consent after being informed with the simplified procedures referred to in Article 13, paragraph 3 “(Article 122, paragraph 1 of the Code).
